Court records also serve as authentic proof of court actions and trial processes including pleadings, motions, hearings, decisions, and judgments. The Clerk of the District Court is the custodian of court records created in Scott County. Members of the public are permitted to request court records under the State’s public records law, including federal case files, arrest information, and other publicly available vital records.

Are Scott County Court Records Public?

Yes. The Rules of Public Access to Records of the Minnesota Judicial Branch govern the rights of the public’s access to court records. Generally, anyone can inspect or copy records maintained by the Scott County District Court. Nevertheless, not all court records are open to the public; under Minnesota’s Court Rule 4, some court records unavailable to the public are:

What Information is Available in Scott County Court Records

A typical Scott County court record discloses the following information:

Online Access: Publicly available Scott County court records are accessible online through the Minnesota Court Records Online (MCRO) portal. Access to case information and records on this portal typically varies by case type. Users can search for court records filed from July 1st 2015, to date on this portal by name, document/case number, hearing, or judgment.

In-Person Access: Concerned persons may obtain court records in Scott County through public access terminals located at the courthouse. In addition, the court clerk’s counter may be queried during official hours for inspection and copying of court records.

Note that for mail requests, the duly completed request form should be enclosed in a self-addressed stamped envelope and should include the copy fees and information about the requested records. Fees for Court Records in Scott County

The fees for copying court records maintained by the Scott County District Court vary by record type, mode of transmission, and volume. The court charges a base fee of $14 per copy for certified copies of instruments or electronically filed documents from criminal/civil proceedings. Copies of records produced from case management systems and provided to requesters via email or paper cost $5 (for documents with 50 pages or less) and $25 (documents with more than 50 pages) respectively. Exemplified and certified copies of instruments from civil/criminal proceedings cost $28 each while exemplified and uncertified copies cost $14 each. Certified copies of birth records are issued at $26 each for the first copy and $19 per additional copy while certified copies of death records cost $13 for the first copy and $6 for additional copies.

Criminal Records Access in Scott County

The Scott County District Court does not handle state-level criminal history checks; rather the Minnesota Bureau of Criminal Apprehension (BCA) manages official statewide searches for criminal history records. However, local criminal case records and information are publicly available through the Minnesota Court Records Online (MCRO) portal. Interested persons may also submit in-person requests at the clerk’s office or make use of the public access terminals provided within the county courthouse.

Scott County Probate Records

Probate records are created from litigation involving trusts, conservatorships, guardianships, wills and probate filings, adoption and distribution of a deceased’s estates. The District Court’s Clerk is the official custodian of Scott County probate records and estate records.

Interested individuals can view and obtain uncertified copies of probate court records generated from July 1st 2015 till present for free online through the Minnesota Court Records Online (MCRO) portal. For access to probate records created prior to July 1st 2015, concerned persons may visit the counter at the clerk’s office in person to request them or use the public access terminals at the courthouse to find such probate records. Note that certain probate records and case information may not be available for public inspection without proper authorization and eligibility.

Scott County Family Court Records

The Scott County District Court has jurisdiction to resolve family law cases and maintain their records. Family Court records consist of records related to divorce, child support, child custody, annulments and adoption proceedings. Because of their sensitive nature, most family court records are usually not available for public disclosure and may require authorization to access them.

Publicly available family court records in Scott County may be obtained online via the MCRO portal or in person at the court clerk’s office. Interested persons may submit a duly completed Minnesota Judicial Branch Copy Request Form through fax, email, or mail to the clerk’s office. The public access terminals provided at the courthouse may also be used to conduct Scott County family Court record searches for free. Note that while inspecting records at the clerk’s office may be free, copies usually attract charges depending on if the record is certified, exemplified or sent through mail.
